In recent years, the Office for Civil Rights in the US Department of Education has become considerably more active and, some would say, aggressive, in investigating and prosecuting alleged violations of the civil rights laws in its jurisdiction. Most notably, OCR has dramatically increased its policymaking and enforcement efforts on Title IX issues; but it has also conducted several prominent investigations on other matters and raised its profile, resulting in resolution agreements with universities around the United States. Omar Syed and Gail Jensen will discuss the best approaches to take when your institution learns it is the subject of an OCR complaint.
