Kyle ZumBerge

Assistant General Counsel - Legal Expert

Mr. ZumBerge graduated with a BSBA from The University of Texas at Dallas in 1995 and with a JD from the University of Houston’s Bates School of Law in 2000.

After graduating from law school, but prior to joining UT System, Mr. ZumBerge worked in the Texas Comptroller of Public Accounts’ Office of General Counsel, as an Assistant General Counsel in Administrative Hearings. Subsequently, he represented the Texas Prepaid Higher Education Tuition Board by serving as Counsel of the Texas Tomorrow Funds.

Currently, he provides counsel to executive officers, leadership and decision makers at UT System and each of its 14 institutions on international, federal, state, and local tax matters, including international payments, deferred compensation, unrelated business income tax, unemployment compensation, multi-state reporting, nexus, payroll taxes, excise taxes, property taxes, nonresident aliens, employee benefits, retirement plans, sales tax, fuels tax, severance tax, hotel occupancy tax, and estate, trust and gift matters. In addition he manages, supervises and coordinates outside accounting professionals and legal counsel involved in tax audits, compliance, and litigation and will contests.

In 2012, he founded the Higher Education Taxation Institute and has served as its Chair since its inaugural year. He has been involved with Tax Section of the American Bar Association and has been an officer in the Business, Corporate and Tax Section of the Austin Bar. He is a licensed attorney with the State Bar of Texas. He has given various presentations, like “UBIT-ter Sweet – You thought you were exempt from tax”, “Qualified Sponsorship – The Basics”, and “A Riddle Wrapped in a Mystery Inside an Enigma – Perhaps There is a Key: Tax Issues Facing Athletic Departments” to various internal and external audiences. He is also involved with various peer groups that focus on tax issues affecting institutions of higher education.
