UTMB Resumes Processing Texas Public Information Requests After Hurricane Ike
On September 11, 2008, the University of Texas Medical Branch at Galveston (UTMB) suspended operations, including responding to public information requests, to prepare for Hurricane Ike. Subsequently, the Office of the Attorney General issued guidelines to governmental bodies affected by the disaster and in accordance with those guidelines on Tuesday, December 9, 2008, UTMB resumed processing open record requests, including those received while campus operations were interrupted.
Individuals and organizations whose requests for information are pending at UTMB should know that:
- UTMB’s telephone system is not yet fully operational.
- Many campus information systems are still temporarily operating off-site which may limit or prohibit UTMB’s ability to comply with requests that require data manipulation.
- Many of UTMB’s paper and electronic records may have been destroyed by flood, mold or other environmental contaminants.
- Heavily damaged wet documents have been frozen in un-catalogued boxes off campus and dry documents in heavily damaged facilities have also been stored in un-catalogued boxes off-site. UTMB plans to review, restore and re-catalogue as much salvageable information as possible; however this lengthy process has not yet begun.
- Because of a reduction in force affecting more than 2,400 individuals, along with the associated transfer of new responsibilities to remaining personnel, established lines of communication among departments have been disrupted.
UTMB is making a diligent effort to mitigate record loss; however, given the above circumstances, the campus may be unable to locate and/or provide certain information sought by requestors. UTMB will, however, respond to all requests in good faith and produce all available public information in a timely and efficient manner given the situation.
To the extent that responsive information is found and exceptions to disclosure apply, UTMB reserves the right to request opinions from the Office of the Attorney General when appropriate and in compliance with the Texas Public Information Act.
